A Daytona Beach workplace injury lawyer from our office could help you pursue either or both types of claims. With over 40 attorneys on staff, we have the experience to assist all kinds of injured workers. What Benefits Are You Entitled to After a Work-Related Injury?
There are several types of compensation you could recover, depending on what kind of claim you file and how severe your injuries are. A Daytona Beach work injury attorney from our law firm could help you understand the damages you can seek through a:
Workers’ Compensation Claim
Workers’ comp may cover:
- The cost of medical care. You will not pay anything for your medical expenses as long as you are prescribed treatment by an authorized physician.
- Temporary wage replacement. The amount paid to you will depend on your wage at the time of your injury and how long you have to stay home from work.
- Permanent disability benefits. Total disability benefits are available in cases where, despite obtaining as much medical improvement as possible, you are unable to ever return to work again. A partial permanent impairment is an injury that allows you to return to work eventually in a limited capacity.
- Vocational rehabilitation, if you cannot return to your old job but might qualify for a new one. This benefit could include the cost of counseling, replacement services, or additional training.
- Death benefits, if your loved one did not survive their workplace accident. Their family could be entitled to funeral expenses, educational benefits for the decedent’s spouse, and lost wages.
If the insurance company tries to dispute the types or amounts of benefits you are eligible for, our legal team can fight for the money you need.
A Personal Injury Claim Filed in Response to a Work Accident
Workers’ compensation only covers certain forms of economic damages, or financial losses associated with your injury. It does not cover any non-economic, or physical and emotional, damages, such as:
- Pain and suffering
- Emotional trauma
- Reduced quality of life
- Loss of independence
- Loss of consortium
- Loss of companionship or guidance in wrongful death cases
Our Daytona Beach personal injury lawyers want to make sure you have a fair chance of recovering all of the compensation you deserve. However, you have a limited time to do so: you must report your work injury within 30 days, and the statute of limitations on personal injury cases is typically two years.

Types of Work Injuries You Can Seek Compensation for in Daytona Beach
Your injury could qualify you for financial compensation if:
- It happened while you were on the job
- The injury or illness was the direct result of you performing your normal job duties
- There are no extenuating circumstances (e.g., you did not cause the injury intentionally)
Qualifying injuries could include head and brain injuries, broken bones, cuts and lacerations, muscle strains and sprains, and back and spinal cord injuries. You could also recover damages for occupational illnesses and repetitive stress injuries.
Different industries come with different risks. For example, a delivery truck driver may be most at risk of injury in a motor vehicle accident, while a construction worker could be at risk of falling or being struck by a heavy object. Even “safe” jobs, like office work, could result in slip and fall accidents or repetitive strain injuries.
Every worker is entitled to a safe environment. No matter what industry you are in or what kind of injuries you suffered, Bogin, Munns & Munns wants to hear from you.
Our Daytona Beach Workers’ Comp Attorneys Can Deal With Challenges
Unfortunately, many workers’ compensation claims are ultimately denied, and personal injury claims may be undercut or undervalued by insurance companies. This does not mean you are out of options.
Our work injury lawyers in Daytona Beach can help you overcome challenges to your claim(s) in the following ways:
Appealing a Workers’ Comp Denial
There are five primary steps in the appeals process:
- Contact the Employee Assistance Office. The Employee Assistance Office (EAO) with the Florida Division of Workers’ Compensation will reach out to the insurance company in an effort to resolve any dispute. This step may or may not resolve the complaint.
- File Your Petition for Benefits. This petition must be filed with the Office of the Judges of Compensation Claims (OJCC).
- Mediation. You will sit down with representatives of the insurance company, along with a neutral mediator. This individual will work to bring both sides together in an effort to reach a resolution for your claim.
- Hearing. If mediation fails, the next step is a hearing before the OJCC. These trials are similar to other civil lawsuits and may include witness testimony and documentary evidence.
- Final Appeal. If you are unhappy with the outcome of the hearing, you have a final opportunity to secure benefits with a final appeal. This happens not within the workers’ compensation system but in the Court of Appeals.
Appealing a workers’ comp denial can be a long, confusing process. Our personal injury attorneys can guide you every step of the way.
Negotiating a Work Injury Settlement
In both workers’ comp and personal injury cases, it is often possible to negotiate for fair payment. This process involves:
- Arranging times and places to meet with the insurers’ representatives
- Bringing in evidence to show that your case is valid and to dispute any arguments the insurer makes against you
- Drafting a settlement agreement that meets your present and future needs
Bogin, Munns & Munns understands that you need compensation to support your family. We can act fast to protect your rights and your future.
