What Will Happen if You Receive an Orlando Sex Crime Conviction?

The penalties that come with a Florida sex crime conviction vary based on the offense’s severity and other factors. Your sex crime lawyer in Orlando can provide insights into the penalties that you could receive if you are convicted.

Below are some of the penalties that you could face due to a sex crime conviction:

Incarceration
Fines
Probation
Having to register as a sex offender in accordance with Florida Statutes § 943.0435
Deportation or denial of citizenship for non-citizens

Outside of these penalties, there are collateral consequences to consider. Such consequences can include housing limitations, employment barriers, internet restrictions, and the potential loss of civil rights, like the right to vote and the right to possess a firearm. Your conviction could also disrupt your relationships with family and friends.

Legal Defenses if You Have Been Charged With a Sex Crime

Your sex crime attorney in Orlando will assess the specifics of your situation as they develop your legal defense. They may explore many legal avenues to prepare a strategy tailored to the facts of your case.

Legal defenses that your lawyer could utilize include:

Consent: Your attorney may argue that the alleged sexual activity was consensual. In your attorney’s argument, they may provide the court with evidence that reflects the nature of the interaction between you and your accuser and the history of your relationship.

False accusation: Unfortunately, there are times when someone will accuse another person of a sex crime due to jealousy, revenge, a child dispute, or anger. In your case, your lawyer may be able to use evidence and witness testimony to demonstrate that you may have been falsely accused of a sex offense.

Mistaken identity: Someone accuses you of a sex crime, but another person may have actually committed this offense. Your lawyer may explain how you are the victim of mistaken identity by detailing your alibi and explaining how you were not present at the location where a sex crime was allegedly committed.

Insufficient or unreliable evidence: Your attorney may challenge forensic evidence or highlight inconsistencies in statements that your accuser makes about you. Doing these things could raise a reasonable doubt about whether the court should convict you.

Improper police procedures: The police obtained evidence without a warrant, or your constitutional rights were violated in other ways. At these times, your lawyer could file a motion for the suppression of evidence, which could damage the prosecution’s case.

Depending on the circumstances, if you have been charged with a sex crime, access to a pre-trial intervention program may be limited. However, the prosecutor in your case may negotiate a plea agreement with your attorney, which may allow you to receive lesser charges than those of your initial offense.
