How can my business avoid litigation?

Your business can diminish the chance of getting sued by taking preventive measures in the beginning:  read and understand contract(s) before you sign anything.  Run your business honestly.  Treat your employees and vendors with integrity and kindness.  Maintain good business records – either pain now or pain later if/when sued.

What should I expect if my case goes to trial?

If you are getting ready for trial, then the litigation has been going on for 1-3 years.  If you have the option to decide whether the trial is jury or non-jury, have candid discussions with your trial attorney as to jury or non-jury trial and the strengths and witnesses of your case.  Be ready and prepared for your direst and cross-examination testimony on the stand – allow your trial attorney to prepare you thoroughly as well as other witnesses.  At this end game stage, resist second guessing your counsel; it will drive you nuts by doing so as trial is stressful enough and trust your lawyer to do his/her best at trial.

My business partner breached our contract. What should I do now?

If your business partner breaches your contract, get a lawyer to review the contract to determine if there was a breach under the contract, and get a legal opinion as to what your rights and duties are under the contract.  After obtaining the legal information, I strongly recommend trying to work it out between the partners – without getting a lawyer involved – first.  Not only is it economical for you, but also hopefully maintains the good relationship upon which you and your partner went into business together.
