In a competitive job market, many companies seek every advantage they can find. One option they use is hiring qualified foreign residents for crucial positions in the United States. This is possible with an H-1B visa, a work permit allowing foreign residents to live and work in the U.S. for a set period.

U.S. companies can hire non-citizens with specific qualifications temporarily. The company initiates this approach, but the foreign worker also plays a part during the application process. With the help of an immigration lawyer from Bogin, Bogin & Munns, it is possible to secure an H-1B  visa and eventually qualify for lawful permanent residency. Our Clermont H1 work visa lawyer can advise you on the best path forward.

    What Is an H-1B Visa?

Although there have been other types of H1 visas in the past, most foreign work permits are H-1B visas today. According to the U.S. Citizenship and Immigration Services (USCIS), these visas provide those living outside the U.S. the opportunity to live and work in the country if they meet certain qualifications and have an offer of employment.

It is important to note that an H-1B is not an immigrant visa. That means an applicant cannot obtain lawful permanent resident status without an H-1B visa. However, they can work in the United States if they remain in the position they applied for and comply with other immigration laws.

An H-1B is not open-ended. Each of these work permits initially lasts for up to three years. However, it is possible to extend the time so a worker can remain in the country longer. The longest an H-1B visa can last in most cases is six years. Some exceptions might extend that period beyond six years, but it is important to discuss those options with an immigration attorney.

H1 Visa Are Not Green Cards

An H1 visa offers foreign residents a path to a green card but does not serve as one. That means having an H1 visa allows you to live and work in the United States under certain circumstances, but a time limit applies to lawful permanent residents.

H1 visas are so popular because they are “dual intent” visas. That means while it is not an immigrant visa, it allows you to work in the United States while working toward green card eligibility.

This is different from a non-dual intent visa that does not allow an applicant to pursue a path to lawful permanent residency. In fact, there are some types of visas that USCIS can reject if an applicant cannot show their intent to return to their home country at the end of the visa period.

H-1B Visas Have Specific Eligibility Requirements

Unlike many other types of visas, you cannot apply directly for an H-1B. Because this is a temporary work permit, your prospective employer must sponsor you before you enter the United States. When doing so, there must be a job waiting for you. These visas are specific to a particular job. That means the visa applies to a single employer at a single location. It is not possible to switch jobs, employers, or locations without receiving approval.

An H-1B visa applicant must have an “employer-employee” relationship with the party sponsoring them. That means they must work for their sponsor in exchange for a paycheck. Different visas are available for business investors or owners. The sponsoring business must also promise to pay for the immigrant’s return trip to their home country if their employment ends prematurely.

There are also credential requirements. In general, an H-1B applicant needs a bachelor’s degree in a relevant field. However, work experience can satisfy this requirement in some cases.

Learn How Our Clermont H1 Work Visa Attorneys Could Help

While it is true that employers must initiate the H-1B process, workers seeking the visa must take steps, too. These steps are important, as even a minor error during the process could put the chances of success at risk. It is helpful to rely on an immigration attorney’s guidance to avoid these risks. Our firm could help with your visa application in the following ways:

    Explaining Your Options

One of the most important ways we can help is by ensuring you understand the process. When you know what to expect, the visa application process can be less stressful. Our attorneys can review your case, help you understand your options, and advise you on what to expect moving forward.

    Communicating With the Sponsor

Your employer or other sponsor is also an important part of the process, and poor communication could set you back. We could communicate with them as needed to ensure all important filings are made, and all necessary documents are provided.

    Preparing You for Interviews

One of the final steps in the process is an interview. The interview is important, as incorrect or inconsistent answers could result in delays or even denials. While it is up to you to tell the truth, being prepared for what questions could be asked is a valuable tool in making it through the interview without issue.
